HKJA 2025 Fundraising Auction General Terms and Conditions 

These Terms and Conditions govern participation in the online auction conducted by the Hong Kong Journalists Association ("Auctioneer" or “HKJA”) from February 28, 2025 until March 1, 2025 on HKJA’s website store.hkja.org.hk. By participating in this auction, whether in person, by telephone, or by proxy, you ("Bidder") agree to be bound by these terms.

1. Auctioneer's Role:

  • The Auctioneer is responsible for conducting the auction.
  • The Auctioneer reserves the right to regulate the bidding process, including setting bid increments, accepting or rejecting bids, and withdrawing any item from the auction.
  • The Auctioneer's decisions regarding the conduct of the auction are final.
  • The Auctioneer will not be responsible for any missed bids from any source.
  • The auctioneer accepts no responsibility for missed or failed bids caused by the failure of internet or server connections.

2. Bidding Process:

  • Bidders must return the registration form and provide identification on or before February 26, 2025.
  • By registering to bid or placing a bid the Bidder agrees to be bound by all of these terms & conditions and any other announced terms and conditions of sale or rules of the Auctioneer.
  • It is the Bidder's sole responsibility to be the judge of the items’ grade or condition by the photos provided. Bidders are further encouraged to contact the Auctioneer with any questions prior to the start of the auction.
  • Placing a bid is a legally binding obligation. There are no returns or exchanges. All lots are sold as is. 
  • The Auctioneer will announce the starting bid for each item.
  • Bids must be made in the designated increments. No fractional bids will be accepted unless announced otherwise.
  • The highest bidder acknowledged by the Auctioneer will be the Bidder for that item.
  • In the event of a dispute between bidders, the Auctioneer will have the sole discretion to determine the successful bidder or to re-auction the item.

3. Tie Bids:

  • In the event of a tie between two or more bids, the Auctioneer will determine the winning bid at their sole discretion.

4. Payment:

  • All sales are final. 
  • Winning bidders may settle full payment by check, or by bank transfer, or by FPS.  
  • The Auctioneer will issue an invoice to the successful Bidder. The successful Bidder may pay in full by bank transfer, FPS or by check after the end of the auction. Upon confirmation of receipt of payment on the next working day, the Auctioneer will ship the item to the Bidder to the address provided. 
  • Full payment is due within 7 days of the end of auction. 
  • Failure to pay within the specified timeframe or to provide the required deposit may result in penalties, including but not limited to, forfeiture of the item and legal action. The Auctioneer reserves their rights to pursue the successful bidder via all legal means necessary for the deposit and any associated losses and interest as applicable.
  • A HK$500 handling fee will be assessed for each declined check transaction and Bidder agrees to such charge. 
  • To comply with HKJA’s Anti-Money Laundering Policy, the Bidder agrees they may be required to submit copies of their proof of ID, proof of address or other documentation for the Auctioneer’s retention. 

5. Item Condition:

  • All items are sold "as is" and "where is" with no warranties expressed or implied.
  • It is the Bidder's responsibility to determine condition, value or any other determinative factor. Due diligence to verify the condition and description of a lot is the sole responsibility of the Bidder prior to placing any bid. 
  • Catalog descriptions are provided for informational purposes only and do not constitute a warranty.
  • The Bidder acknowledges that they are not able to inspect the lots beyond photos prior to the auction, and that such examination is not as good as if they examined it in person.
  • The Auctioneer is not responsible for any errors or omissions in the catalog or descriptions of the items.
  • The Auctioneer may attempt to describe the items in advertising, on the internet, and during the auction. Any description referring to the item’s grade or condition is completely the subjective opinion of the Auctioneer and the Auctioneer makes no express or implied warranties based on the subjective descriptions of any coins being sold.

6. Ownership and Shipping:

  • Ownership of the item transfers to the Bidder upon full payment.
  • The Auctioneer will be responsible for shipping the items to the winning bidder to the address provided.
  • Returns may only be made with the advance written authorization of the Auctioneer and are in the Auctioneer' sole discretion to approve.

7. Withdrawal of Items:

  • The Auctioneer reserves the right to withdraw any item from the auction at any time, even after bidding has commenced, without any liability to the bidders.

8. Cancellation of Sale:

  • The Auctioneer reserves the right to cancel the sale of any item if payment is not received, or if the Auctioneer deems it necessary for any other reason.

9. Liability:

  • The Auctioneer is not liable for any personal injury or property damage that may occur on the auction premises.
  • The Auctioneer's liability to a Bidder for any reason shall be limited to the amount of the Bidder's premium paid.

10. Governing Law:

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong.

11. Entire Agreement:

  • These Terms and Conditions constitute the entire agreement between the Bidder and the Auctioneer regarding the auction and supersede any prior agreements or understandings.

12. Amendments:

  • These Terms and Conditions may be amended or supplemented by the Auctioneer at any time, with or without notice. Any announcements made by the Auctioneer during the auction shall take precedence over these written terms.
